Compensation For Pain And Anguish

Where there is generally universal acceptance by jurors that a person harmed by the fault of another is entitled to compensation for past and future medical expenses, there almost always disagreement on the amount of compensation a person should receive for the physical pain experienced in conjunction with an injury. Regardless of personal feelings, the law recognizes physical pain is a harm that should be compensated for in a reasonable amount. The law further recognizes that mental anguish, such as stress, feeling tired, feeling depressed and even the inconvenience associated with regular trips to the doctor, is also a harm that should be compensated for in a reasonable amount. The two factors that a juror should consider when rendering an award for physical pain and mental anguish are (1) severity and (2) duration.
